TERMS AND CONDITIONS:
1. INTRODUCTION
1.1. These Terms and Conditions ("Terms") govern participation in the "Hello Sabah Fun Run" (the "Event"), organised by Sri Pelancongan Sabah Sdn. Bhd. ("Organiser").
1.2. By registering for the Event, participants agree to comply with these Terms and any other instructions provided by the Organiser.
2. ELIGIBILITY
2.1. The Event is open to all Malaysian and non-Malaysian participants.
2.2. Participants must be in good health and physically capable of completing the run. The Organiser reserves the right to refuse entry to anyone who is deemed unfit or unable to participate safely.
3. REGISTRATION
3.1. All participants must complete the registration process, including payment of any applicable fees, by the deadline set by the Organiser.
3.2. Registration is non-transferable and non-refundable, except as provided by law or as determined by the Organiser at its sole discretion.
4. EVENT RULES
4.1. Participants must follow the designated route and obey all traffic regulations, race marshals, and police instructions.
4.2. Each participant is free to choose his or her own attire for the Event. However, the usage of transparent attire is strictly prohibited.
4.3. Participants are prohibited from bringing pets, bicycles, roller blades, or any wheeled devices (other than wheelchairs or baby strollers).
4.4. Participants will get a running T-shirt and a finisher’s medal.
4.5 Runners are required to be self-sufficient on the run course with water/aid stations (W) set up to cater for the refilling of hydration packs or water bottles at intervals of about 2 kilometres to 3 kilometres along the marked race course.
5. EVENT CANCELLATION OR MODIFICATION
5.1. The Organizer reserves the right to cancel, postpone, or modify the Event due to unforeseen circumstances, including but not limited to weather conditions, natural disasters, or government restrictions.
5.2. In the event of cancellation, the Organizer may offer a partial or full refund or provide an alternative event date, at its discretion.
6. WAIVER AND RELEASE OF LIABILITY
6.1. By participating in the Event, participants agree to the waiver and release of liability as detailed in the Event Waiver.
6.2. Participants assume all risks associated with participation, including but not limited to falls, contact with other participants, and the effects of weather.
7. DATA PROTECTION
7.1. The Organizer will collect and use participants' personal data in accordance with applicable data protection laws for the purpose of organising and managing the Event.
7.2. Participants consent to the use of their names, photographs, and any other media for promotional purposes related to the Event.
8. CODE OF CONDUCT
8.1. Participants are expected to conduct themselves in a respectful and sportsmanlike manner. Any form of harassment, discrimination, or inappropriate behavior will not be tolerated and may result in disqualification.
9. ACCEPTANCE OF TERMS
9.1. By registering for and participating in the Hello Sabah Fun Run, participants agree to be bound by these Terms and any additional instructions provided by the Organiser.
WAIVER AND RELEASE OF LIABILITY
In consideration of being allowed to participate in the "Hello Sabah Fun Run" (the "Event"), I, the undersigned, acknowledge, appreciate, and agree to the following terms:
I understand that participating in the Event involves inherent risks, including but not limited to the risk of injury, illness, and even death. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me as a result of participating in the Event, whether caused by the negligence of the organizers or otherwise.
I hereby release, waive, discharge, and covenant not to sue the Event organizers, sponsors, volunteers, and any of their agents, employees, or representatives (collectively referred to as "Releasees") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me while participating in the Event.
I consent to receive medical treatment deemed advisable in the event of injury, accident, or illness during the Event. I understand and agree that I am responsible for all costs related to medical treatment, transportation, and any other costs related to my care.
I grant permission to the Event organizers and their representatives to take and use photographs, videos, or other recordings of me for promotional, educational, or other purposes without compensation to me. I understand that all materials are the property of the Event organizers.
I agree to comply with all rules and regulations established by the Event organizers. I understand that failure to comply may result in my disqualification and removal from the Event without refund.
I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs, including court costs and attorney's fees, that they may incur due to my participation in the Event, whether caused by the negligence of the Releasees or otherwise.
I agree that if any portion of this waiver is held to be invalid or unenforceable, the remaining portions shall remain in full force and effect.
ACKNOWLEDGEMENT OF UNDERSTANDING
I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue.
